국문 초록

본 연구는 장애인 등 특수교육 대상자의 의무교육에 대한 법적 규정을 고찰함을쏘 구체적인 논의대상을 모색해 보는데 목적을 두고 있다. 본 논의를 위해 우선 의무교육 제도가 권리 사상과 어떻게 결부되어 발전하였으며, 특수교육 대상자가 지닌 권리성이 어떠한 것인지에 대해 살펴보았다. 다음으로 의무교육에 대한 현행 법제를 고찰해 장애인에 대한 의무교육 제도를 논의하기 위한 기초 작업을 행하였다. 마지막으로 의무교육에 대한 쟁점으로 의무교육 이행의 장, 의무교육 기간의 규정방식, 의무교육의 면제와 유예에 대한 상항을 논의하였다. 그 결과 특수교육 대상장의 경우 외적으로 드러나는 장애뿐만 아니라 교육적 요구가 있는 경우까지 포괄하는 넓은 의미로 이해되어야 하기 때문에 일반 아동에 비해 다양한 관점에 의한 의무교육 제도의 정비가 필요하였다. 의무교육의 장에서는 취학 의무뿐만 아니라, 교육의 의무에 대한 사항까지 고려해 보아야 할 것이며, 의무교육 기간의 규정에서는 연령주의, 연수주의, 과정주의 전반에 걸친 검토가 필요하였다. 의무교육의 유예나 면제에서는 그 사유가 보다 한정적이고 구체적이어야 함이 요구되었다.

영문 초록

This is study attempted to explore issues and problems telated to compulsory education system for children with disability in legal aspects. For this end, literatures were reviewed and various education laws, regulations and documents were investigated. Literature review was conducted to develop that ideas of rights to compulsory education for regular students are closely related to those for children with disability. Structures of general education laws and Act on Special Education for Disabled Persons, Etc. were compared. Later, limitation of compulsory education were discussed when ir was applied for the children wirh disability. In conclusion, it is inappropriate that children with disability are tuled by compulsory education system based on setting of schooing，schooling age，an exemption and delay of schooling. If compulsory education system is designed to provide an effective opportunity for all students, it should be duties and rights to enter elementary schools at schooling age. Howere, it appeared that the duties and rights to enter elementary schools at certain schoolling ages function as inhibitors against the disability with potentials far beyond those of regular students. Therefore, children with disability should be synthesis ruled under flexible systems of compulsory education if their achievement level is assessed as sufficient to enter elementary schools before schooling.
