영문 초록

The purpose of this study aims to analyse the practical problems on the exemption clause of time on demurrage under voyage charter focused on the Asbatankvoy Form. The Asbatankvoy form consists of a preamble and two parts Much of the same basic clauses noted in relation to the Gencon charterparty are to be found in this charterparty The main differences relate to clauses which are unique to the oil trade There are, for example, special clauses which deal with the allocation of responsibility for pumping oil on to and off the vessel and the provision of hoses for mooring at sea terminals Vessel not to render N/R at loading port prior to laydays unless charterers give their consent to do so N/R was, in each case, given outside the hours stipulated in the charterparty The charterers contended that the notices were invalid and of no effect, having been tendered outside the specified period
