부필지 기반의 3차원 지적 등록모형 개발

국문 초록

지적제도를 운영하는 대부분의 국가에서 현행 지적의 형태는 토지를 수평적으로 일정한 기준에 의하여 토지필지 단위로 구획하여 물리적 현황과 법적권리관계 등을 공적장부에 등록·공시하는 지적제도로 차원적 측면에서 볼 때 2차원이다. 그러나 단순하게 지표면만 사용되던 토지의 이용형태는 토목·건축기술 등의 발달로 인하여 지표면뿐만 아니라 지상 및 지하공간까지 개발이 확대됨에 따라 입체적 토지이용의 증가에 따른 입체적 공간객체의 물리적 현황과 복잡한 권리관계를 효율적으로 등록하는 것이 기존 2차원 지적으로는 매우 어려운 실정이다. 본 연구는 현행 2차원 지적의 형태를 유지하면서 지하 및 지상공간에 건설된 건축물 및 구조물을 효율적으로 등록하는 방안을 제시하는데 있다. 이를 위해 부필지의 개념적 토대를 마련하기 위하여 세부적으로 3차원 지적의 개념을 고찰하였다. 뿐만 아니라 토지의 입체적 사용에 따른 국내의 등록실태와 부필지와 관련한 외국사례를 살펴보았다. 이를 토대로 부필지의 개념 및 등록대상, 등록범위, 구성요소, 공적장부 등을 정의함으로써 부필지 기반의 3차원 지적등록 모형을 제시하였다.

영문 초록

Currently 2-dimensional(2D) cadastral system has been managed in the most of countries in the world which divides a pice of land into parcels and registers legal rights and physical conditions in horizontally on the public records such as cadastral book and cadastral map. Since the land use expanded to not only earth surface but also the underground and 3 dimensional space according to the development of civil engineering and architecture technology, it is almost impossible to register and manage 3 dimensional object's right relationship with the existing 2 dimensional environment. The main research objectives are to present an effective methodology which register buildings and facilities in the underground and air space on the current 2D cadastral framework. In order to achieve the research objectives, a sub-parcel concept has been investigated through a comprehensive literature reviews. Based on the theoretical concepts of sub-parcel, registration objects, range of registration, components and public records a sub-parcel concept based cadastral registration model for 3D cadastre has been defined.
