국문 초록

토지경계는 하나의 필지를 구성하는데 있어서 가장 중요한 성립요건인 동시에 소유권이 미치는 한계로써 매우 중요한 역할을 하고 있다. 우리나라는 토지경계 분쟁 시 특별한 사정이 없는 한 도상경계를 법정 경계로 사용함으로써, 지상경계와 도상경계, 도상경계와 점유경계에 따른 소유권 분쟁 시 도상경계를 해결의 기준으로 사용하고 있다. 본 연구의 목적은 지적경계분쟁에 대한 평가와 해결방안을 제시하는 것이다. 경계분쟁 해결절차에 있어서 현행 지방지적원원회와 중앙지적위원회가 존재하지만 법적 권한이 주어지지 않고 단지 측량성과에 대한 정오만을 제시하는 기능으로 머물고 있다. 이러한 조직을 지적측량기술자, 지적직 공무원 외에 판사 등 관련전문가를 포함시켜 조직화함으로서 경계분쟁에 따른 절차를 간소화함으로서 실질적인 지적위원회로서의 기능을 부여하고자 함이다. 이렇게 함으로서 국민의 토지재산권에 대한 적극적인 의사표시가 가능하여 토지경계분쟁을 억제하고 토지사용에 효율성을 높이는 결과가 될 것이다.

영문 초록

The land boundary is one part of parcel, which is one of the most important requirements of the establishment, but also as a very important role to limit ownership. Korea is used to map based boundary for a special situation to happen a land boundary except special cases, because it is useful to a kind of solution for solving disputes of property ownership between field boundary and map boundary as well as map boundary and occupied boundary on field. The purpose of this study pointed out that the evaluation of the boundary dispute and suggested ways to resolve it. The boundary dispute resolution procedures in the current times, and the local cadastral committee and central cadastral committee pointed out that legal authority exists, but not only given for the simple level of the capability of staying present only at noon. Thus these organizations need cadastral surveyors, cadastral officials including judges and other professionals organized by the boundary dispute to streamline the process by substantial intellectual function. In this way the people's land and property rights in the mark is ideal for willings actively to suppress the land boundary disputes and land use efficiency and increase the results will be.
