국문 초록

현행 지적제도는 토지의 제반 등록사항을 국가가 등록하고 관리하고 있으나 제도적으로 공신력이 미흡하므로 보다 적극적인 토지등록과 소유권 보호를 위한 보증절차 제도가 필요한 실정이다. 이러한 배경에서 본 연구는 지적제도에 보증보험제도를 도입하여 전통적 이념의 국정주의와 직권등록주의의 범주에서 벗어나 새로운 개념의 적극적 토지등록과 민간보증보험의 접목을 시도하였다. 지적보증제도는 국가에서 등록․관리하고 있는 지적공부 및 기타 토지관련 자료에 대하여 그 내용을 다시 조사하고 확인하여 정보의 정확성을 보증하고자 하는 제도로서 이러한 일련의 과정과 보증절차를 적극적 토지등록이라 표현하였으며, 보다 정확하고 신뢰받는 국가 공간정보 인프라를 구축하기 위해서는 지적보증제도의 도입이 필요한 것으로 나타났다.

영문 초록

The current indication system the nation registers the various registration fact of the land and is managing institutionally the public trust is insufficient is the actual condition where the guarantee process system for the land registration section right of ownership protection which is active is necessary. The research which sees consequently introduced an indication and surety insurance system and escaped, attempted from category of state attention and authority registration attention of traditional ideology, or the grafting of active land registration section civil surety insurance of new concept. Is more accurate research result and in order constructs national spatial information infra is trusted from appeared with the fact that the introduction of indication guarantee system is necessary.
