국문 초록
우리나라에서는 물론 세계에서도 사형정책은 오랜 논쟁의 대상이 되어 왔으며 이러한 오래된 논쟁은 종종 그 나라의 사형정책과 사형수에 대한 사회복지 정책의 방향을 결정해 왔다. 그러나 국내에서는 전문가이든 비전문가이든 사형존폐론에 끼어든 상태이며 오랜 왜곡된 논쟁을 계속해 왔다. 따라서 사형수에 대한 올바른 사회복지 정책을 확립하기 위해서는 먼저 국내에서 전개되고 있는 사형 제도를 소개하였다. 나아가서 현재 국내 사형수에 대한 사회복지 정책의 현주소와 문제점들을 나열한 다음에 한국에서 사형수에 대한 사회복지 정책의 나아갈 방향을 운론해 보았다.
영문 초록
For along time korea penal system have maintained the death penalty system in spite of the recommendation of the international convenants and other human rights instrument which had a big influence in penal politics system of the countries with sentence of death and a criminal under sentence of death.
And yet korea penal politics system have maintained the death penalty politics system and now under way, korea president and the ministry of justice who are under an obligation to execute death penalty for a criminal under sentence of death have not put to death for ten years due to being afraid of becoming the target of criticism which is originated in putting to death for a criminal under sentence of death.
Thus in fact a criminal under sentence of death have been considered life and long-term prisoners, but the treatment of the criminal under sentence of death have been treated unfairly as compared with life and long-term prisoners and convicts and united nations recommendations on life imprisonment, such as opportunities for communication, opportunities religious rights opportunities social contacts including family contact, opportunities basic rights for human life in prison, opportunities cultural social welfare and so on.
Thus in this study, I asserted that the social welfare politics of prisoners under sentence of death, such as a medical insurance social welfare politics, a family social welfare politics (including sex rights), an industry social welfare politics of the labor rights of correctional prison in the pointed space and the workmen"s accident compensation insurance in the pointed space, a cultural social welfare politics(TV seeing and hearing, radio hearing rights and so on), a religious social welfare politics about the decisive power of the choice of the various religion acceptance, a basic life rights in the prison.
My opinion in this study tallies with the united nations safeguards guaranteeing protection of the rights of those facing the sentence of death penalty article 9.
Finally introducing andrew coyle"s opinion in the human rights approach to prison management(king"s college London, 2002, 144page), He asserts that prisoners under sentence of death retain all the rights to which prisoners in general are entitled and It is particularly important to ensure that they don"t receive a lower standard of treatment in terms of such matters as food, heath core, hygiene, exercise and association with other prisoners.
