국문 초록

  재건축을 둘러싼 갈등은 기본적으로 수익성과 공공성간의 대립에서 연유한다. 재건축과 관련하여 전자를 강조하는 입장이 시장주의라면, 후자를 선호하는 입장을 규제주의라 할 수 있다. 우리나라 재건축제도는 현재 수익성 우선에서 공공성 우선으로 옮겨가는 와중에 있다. 재건축을 둘러싼 갈등은 수익성 대 공공성, 시장주의 대 규제주의 간 대립에서 빚어지는 것이다. 이 글은 우리나라 재건축 제도의 흐름을 개관하면서 재건축의 쟁점을 검토한 뒤, 실제 재건축 규제를 둘러싸고 나타나고 있는 시장주의와 규제주의간 충돌의 지점들을 분석하고, 끝으로 상생의 재건축을 위한 조건과 빙식을 찾아보는 것으로 전개된다.

영문 초록

  Conflicts around the rebuilding of apartment arise from the confrontation between profitability and public interests related to the rebuilding. Profitability is represented by marketist, while public interests are favored by regulationist. Policy for apartment rebuilding is at a stage of transition from profitability to public interests principles. This paper is organized as follows. It begins with review of the policy of apartment rebuilding, by drawing issues regarding the practices of apartment rebuilding. Then it moves on analyzing the locus of conflicts between marketist and regulationist involved in the business of apartment rebuilding. Finally it seeks conditions and ways for "symbiotic rebuilding".
