영문 초록

  According to a Statistical Yearbook of Justice, demand procedure occupied 20.8% of civil cases in 2005. Although, the demand Procedure seized considerable rate, practical and theoretical concern was indifferent to it all the while.
  However, the demand procedure has a number of issues to be researched in order to act effectively and adequately in judicial procedure.
  This study andlyzes legislative history of the demand procedure in Germany and Japan as these countries" respective procedures have influenced our procedure.
  After examining the latest revision of our demand procedure in that order, I suggest the proposal of improvement of the demand procedure.
