영문 초록

  The constitutional principles on which the judicial system is organized, are the specialty, independence and democracy. This thesis aims to analyze the history of the judicial system from this constitutional view-point. The judiciary plays its role to interpret and apply the state norms in the political process, because the judiciary has the right to control and supervise the executive branch to make the state activities conformed with the laws and to review the constitutionality of the laws enacted by the legislative branch. The judiciary is not the outsider of the political process any more. Therefore to estimate the degree of the accomplishment of the principles, we should analyse the relation between the state and civil society.
  In this thesis, the 60 years from the emancipation from the colonial domination in 1945 to now, are divided into 7 periods according to the political changes. I analyse the relation between the judiciary and the executive, the characteristic of the political power, and estimated the achievement rate of the constitutional principles on which the judicial system is organized.
