영문 초록

The newly revised version, the first since 1994, of the PRC's Foreign Trade Law took effected on July 1 2004. The Law permits to “foreign trade operators” to carry out the import and export of goods, technology and to trade in services. The new revisions will bring Chinese law into closer conformity with the PRC's WTO obligations. The environment for foreign companies will not be free from future surprises, but in general will be more familiar, and will reward companies for conforming their PRC trading practices with their practices in other major markets and with WTO principles. Thus, the purpose of this study is to compare the PRC's revised Foreign Trade Law with current one, and suggest its implication to korean trade company wish to enter into business with Chinese company. The conclusion of this study are summarized as follows; First, the revised PRC's Foreign Trade Law is relatively complete, but the effective implementation of the law can not be achieved without the amendments of the related regulations. Second, the company wish to business with a Chinese company must know that most of trade in China are made by administrative customs and other rules. Thus, understanding on administrative customs and other trade-related rules of China is considerably needed. Third, the Korean trade company has been exporting in China are do their level best for total management in trade risk. because a trade disputes with China are now expected to be increase especially trade payment.
