북한의 장애인 교육법에 대한 탐색적 연구: '장애자보호법'의 내용과 특성

국문 초록

북한은 2003년도에 장애인 교육, 복지, 노동, 문화생활 등의 내용을 전반적으로 다루고 있는 ‘장애자보호법’을 제정·공포하였다. 남한의 법률체계와 비교하여 볼 때, 이 법률은 장애 및 장애인과 관련된 다양한 분야를 포괄한 기초적인 법률로서 북한의 장애인 정책의 기본 방향과 제도적 장치를 명시해주는 근거이다. 이에 본 연구에서는 북한이 발표한 ‘장애자보호법’의 법적 체계와 내용 및 특성을 살펴보고, ‘제3장 장애자의 교육’을 남한의 특수교육진흥법과의 대조를 통하여 자세히 살펴보았다. 이는 북한의 현 장애인 관련 제도와 정책 방향을 이해하고, 향후 남·북한 특수교육의 통합을 위한 기초 자료로서 의의가 있을 것이다.

영문 초록

North Korea enacted and announced 'The Person with Disability Protection Law (PDPL. 장애자보호법)' in order to boost the education, welfare, work, and rehabilitation of person with disability in 2003. Since PDPL provided all aspects of policy about people with disabilities as well as special education in North Korea, the purpose of this study is to analyze the content of PDPL and to contrast it with the special education law in South Korea. In the result, we got hold of several characteristics of PDPL. First, PDPL is differed from that of South Korea, in terms of the terminology. Second, PDPL does not describe identification and diagnosis, inclusion, IEP, and so on. Third, North Korea provide compulsory and free education for children with disabilities. Finally several implications were discussed.
