영문 초록

The purpose of this study is to review and to provide the traffic- related Act in Korea. The traffic offenses is one of the prominent crimes in our society. The traffic offenses as a category was the most prevalent in 2001, accounting about 40% of total offences in Korea. With the legal problem on the traffic offenses, we tried to examine the traffic-related law such as Road Traffic Act, Special Act Concerning the Disposition of Traffic Accidents, and Act Concerning Additional Punish- ment for Specified Crimes(Article 5-3). Road Traffic Act arms to secure safe and smooth traffic by preventing or removing all dangers which may occur on the roads. The purpose of Special Act Concerning the Disposition of Traffic Accidents is to facilitate the prompt recovery of damages caused by traffic accidents and to promote the convenience for the people, by providing special measures on criminal punishment for drivers involved in the traffic accidents through occupational or gross negligence. Act Con- cerning Additional Punishment for Specified Crimes(Article 5-3) arms to impose the aggravated penalty to the driver who leaves the scene of the traffic accident. In this study, we have reviewed traffic-related Act, and explored the just and pair criminal policy in traffic offenses in Korea. We wish this study to contribute to the dispositions of traffic offenses in our society.
