해양스포츠관련 법령의 문제점과 개선방안

국문 초록

국토해양부는 2010년 7월 해양관광·레저산업을 미래 성장동력으로 육성하기 위한 ‘해양관광·레저 활성화 방안’을 마련하였다. 특히, 이 활성화 방안은 연안 해양관광·레저 활성화 외에 수변지역을 활용한 수상레저·스포츠 및 관광 활성화를 위한 인프라 확충을 위한 계획과 마리나항만을 적극적으로 개발하는 계획이 포함되어 있는 것이 특징이다. 최근에 정부가 추진하고 있는 녹색성장에 맞추어 해양레저 산업은 우리나라의 세계최고수준의 조선기술과 IT기술을 활용하여 요트를 생산하고 레저스포츠를 활성화한다면 환경오염이 없는 고부가가치를 실현할 수 있는 미래의 신성장동력 사업으로 기대되고 있기 때문에 전국 지방자치단체에서는 매년 70여 개의 해양관련 행사를 개최하고 있고 국가도 관련 법령을 정비해서 적극적으로 지원하고 있다. 그러나 현행 레저스포츠와 관련한 법령은 요트를 반드시 등록하도록 하고 요트조종면허를 취득하지 못하면 요트를 운행할 수 없는 등 규제위주로 되어 있고, 요트 등록도 크기에 따라 수상레저안전법에 의한 등록과 선박안전법에 의한 등록으로 이원화되어 있고 이에 따라 관할 부처도 나뉘어져 있어서 요트이용자들이 복잡한 법체계와 절차로 인해 큰 불편을 겪고 있어서 해양레저스포츠 및 해양레저산업을 육성하려는데 장애가 되고 있는 실정이다. 따라서 본 논문은 해양레저스포츠의 활성화에 장애가 되는 요트(선박) 등록 제도를 규제 완화에 맞게 통일적으로 일원화해서 등록할 수 있도록 하고, 요트조종면허도 일반 선박운전면허를 취득하면 별도로 취득하지 않아도 되도록 하는 등 해양레저스포츠 관련 법령들의 문제점을 검토하고 그 개선방안을 제시하였다.

영문 초록

In July 2010, Ministry of Land, Transportation and Maritime Affairs arranged ‘marine tourism & leisure sports revitalization plan’ for the purpose of cultivating marine tourism & leisure sports industry into a future growth engine. One of the special features of this revitalization plan is its inclusion of a plan to expand the necessary infrastructure for revitalizing aquatic leisure & sports activities utilizing waterside areas as well as a plan to actively develop marina harbors and bays in addition to its inclusion of a plan to revitalize the coastal marine tourism & leisure sports activities. The marine leisure industry is being considered and expected as a future new growth engine for realizing high added values without environmental pollution by utilizing our shipbuilding technological know-how and IT technologies, which are at the world’s top level, according to the green growth initiative being implemented in recent by the government. Accordingly, the local governments throughout the country are hosting about 70 marine related events every year and the government is also actively providing support through the maintenance of related laws and ordinances. However, the present circumstance in regards to the current laws and ordinances on marine leisure sports is that it is mandatory to register yacht and those who have not obtained their yacht operation license cannot operate yacht. In addition, yacht registration is divided into two subsets of registrations – registration according to Marine Leisure Safety Law and registration according to Ship Safety Law – that are handled and processed by two different related ministries and offices, thereby causing much inconvenience to yacht users due to complicated legal system and process. All of these work as hindrances in cultivating marine leisure sports and marine leisure industry. Accordingly, the legal issues in marine leisure sports were examined and an improvement plan has been present in this thesis for the purpose of unifying the yacht (ship) registration system, which is working as a hindrance in revitalizing marine leisure sports, by alleviating the regulation, and not making it mandatory for those who have obtained their ship operation license to also obtain yacht operation license.
