장애인복지서비스 연계를 위한 법적 제도화 방안 고찰

국문 초록

본 연구에서는 장애인복지 서비스 연계를 담보하기 위한 법적 제도화 방안을 고찰하였다. 2006년 이후 본격적으로 논의되어 온 장애인복지전달체계의 개편 노력은 현재에도 진행 중이며 이러한 개편 노력 중의 하나는 장애인에게 필요한 서비스를 파악하고 서비스를 제공하는 것을 목표로 하는 원스탑 서비스 체계의 구축이다. 장애인복지의 일반법적 성격을 가지고 있는 장애인복지법 상 장애인에 대한 급여제공은 관련 법에 정해진 내용을 조합한 서비스 지원 종합조사에 머무르고 있어 장애인의 필요 서비스를 파악하고 제공하는 정도에까지는 이르지 못하고 있다. 이에 비해 발달장애인법은 개인별지원계획을 제도적으로 도입하면서 장애인에 대한 서비스 욕구를 보다 포괄적으로 파악하는 체계를 구축하였고, 개인별지원계획에 따라 서비스가 제공되어야 하는 규정을 명문화하였다. 그러나 이러한 제도적 진전에도 불구하고 개인별지원계획이 계획에 따른 실질적인 서비스 제공을 담보하는 데에까지는 아직 이르지 못하는 것도 사실이다. 이러한 문제가 발생하는 이유는 발달장애인법에서 예정하고 있는 서비스 연계에 대한 명확한 의미가 마련되지 못하고 있기 때문에, 또 한편으로는 서비스 제공기관이 개인별지원계획에 따라 의뢰된 서비스를 제공할 협력적 의무가 없기 때문이다. 이를 위한 대안적 제도화 방안으로 첫째, 서비스 연계의 의미를 느슨한 수준이 아닌 서비스 제공까지를 의미하는 것으로 명확히 할 필요가 있으며, 둘째, 서비스 제공기관의 협력 의무를 강화하기 위해 정당한 이유 없이 개인별지원계획에 따른 서비스 의뢰를 거부할 수 없도록 하며 서비스 제공에 따른 추가적인 재정적 지원을 병행할 필요가 있음을 제안하였다.

영문 초록

This study considered legal institutionalization measures to ensure the service collaboration of welfare services for the persons with disabilities. Efforts to reorganize the welfare service system for the people, which has been under discussion since 2006, are still ongoing. Such efforts are aimed at establishing a one-stop service system, and one of the main challenges of this system is to establish a system to understand the services necessary for the persons with disabilities and to provide services. Under the Welfare Law for the Persons with Disabilities, which has the general legal characteristics of welfare for the people, the provision of them is limited to a comprehensive survey of service support based on related laws. On the other hand, the Act for the Persons with Developmental Disabilities introduced personal support plans, established a more comprehensive mechanism for understanding service requirements for them, and stipulated the provisions to be provided in accordance with the established personal support plans. However, despite these institutional developments, the individual support plan has not been able to guarantee substantial service provision based on the plan. This study raised a problem that arose because the service provider did not have an attractive plan for the provision of services requested by the personal support plan, as the planned service link could not be provided in the Act for the Persons with Developmental Disabilities As an alternative institutionalization, it was proposed that, in order to strengthen the cooperation obligation of service providers, it should not be possible to reject individual support plans and provide financial support in parallel.
