3D 프린팅 총기의 위험과 규제의 필요성

국문 초록

일명 ‘새롭게 떠오르는 기술(emerging technology)’이라고 하는 신기술의 개발은 인간이 살아가는 사회일반생활영역뿐만 아니라 테러와 범죄의 영역에 이르기까지 넓은 스펙트럼에 걸쳐 근본적이고 구조적인 변화를 가져오고 있다. 이들 중 3D프린터로 인한 테러와 범죄의 양태와 방법의 변화도 점 차 현실화 되고 있다. 최근 들어 발생한 독일의 극우극단주의 테러리스트에 의해 감행된 유대교 예배당에서의 3D프린터 제작 모의총기 난사사건과 영국과 미국 등에서 발생하고 있는 3D프린터 제작 총기의 불법유통 등의 사례들이 이러한 위협이 현실화되었음을 보여주고 있다. 그러나 이러한 현실 과 달리 국내에서 3D프린터 모의제작총기에 대한 규제와 법적·정책적 대응에 대한 논의가 거의 없다는 점에서 문제를 인식하고 국내에서의 관련논의의 필요성을 제시한다. 이 같은 연구의 필요성에 따라 이 연구는 최근 신기술로 인한 테러와 폭력의 위협과 관련된 3D 프린터를 이용해 제작된 모의 총기 관련 국내의 법률규정과 안전관리 그리고 대응방안에 대해 분석하고 관련 입법과 제도적 대응 의 필요성에 대한 논의를 제시한다. 이 연구의 목적을 달성하기 위해 문헌분석을 통해 이 연구는 3D프린터로 제작된 모의 총기로 인해 발생한 테러사건이나 테러의 위협 그리고 범죄와 관련된 해외 의 사례들에 대해 소개한다. 그리고 국내와 대비되는 사례로서 미국의 3D 프린터 제작 총기와 관련 된 입법과 관리에 대해 비교·제시하였다. 결론에서 이 연구는 국내의 3D 프린터 제작 모의 총기를 규제할 수 있는 입법적·정책적 대안을 제시한다.

영문 초록

Emerging technologies such as artificial intelligence, drone, and machine learning, have been changing the way of lives of modern society. Among these emerging technologies, 3D printing gun appears to be a significant threat to security and crime and terrorism prevention policies of criminal justice system. That is because weapon manufacturing has been significantly changed because of emerging of 3D printing technicology. Today, it is not the sole domain of arms industry could manufacture and distribute firearms. Anyone who has a 3D printer at home be able to create parts of gun and rebuilt it and use a live firearm. In fact, there are a few of cases have been reported that criminals and terrorists 3D printing gun for terrorism and illegal trade and smuggling. For example, a German who neo-Nazi terrorist attacked synagogue in Germany with 3D printing guns. As such, the threats of 3D printing gun became reality. In order to respond to the threats of 3D printing gun weaponization, some countries adopted new measures of gun control laws and policies. In this study, the authors conduct contents analysis to investigate the current laws and measures regarding 3D printing gun controls in South Korea. Furthermore, this study explored the measures and system about gun control including 3D printing guns in the U.S for comparison purpose. In results and discussion, this study suggested revision of counterterrorism polices, laws, and practices in terms of controling 3D printing guns.
