혼인과 가족개념의 변화에 대한 헌법적 대응

국문 초록

가족의 구성에 있어 개인의 가치관과 취향에 따른 자율적 선택권이 보편적으로 수용됨에 따라 가족의 형태적 다양성이 두드러지게 증가하고 있다. 그 결과 핵가족 형태는 전체 가구의 절반에도 미치지 못하고, 직계가족의 형태인 2세대, 3세대 가족은 지속적으로 감소하며, 1인 가구나 비정형가구는 크게 증가하고 있다. 또한 가족생활의 내용적 측면에서도 이러한 다양성을 확인할 수 있는데, 재혼가족, 조손가족, 한부모가족, 미혼부모 가족, 국제결혼으로 맺어진 다문화가족 등의 꾸준한 증가가 그것이다. 가족구조의 변동에 따라 이혼과 재혼, 동거 등이 늘어나면서 기존의 부계가족이나 표준가족과는 다른 유형의 가족이 나타나고 있는 것이다. 주로 가족의 다양화란 가족의 구조 변동과 관련된 것으로 가족의 장기적 해체과정의 다른 표현이라고 할 수 있다. 이혼, 재혼, 동거, 미혼 또는 비혼의 증가가 가족 해체의 또 다른 표현이기 때문이다. 이런 맥락에서 가족 다양성론은 부계 확대가족이나 표준가족만을 정상(正常)가족으로 파악하고, 이것을 고집하는 편협한 보수적 가족주의에 대한 비판적 의미를 갖는다. 그러나 가족 다양성론은 이러한 보수적 가족주의와 대립하는 과정에서 시야가 제한되기 때문에 다양하고 전통적인 가족들이 해체되는 경향을 보지 못한다. 이런 맥락에서 가족 다양성론은 가족의 해체와 획일화에 대한 은폐(隱蔽)일수도 있다. 본고에서는 변화되는 혼인과 이혼에 대한 개념과 그에 따른 변화하는 가족 유형의 다양성을 검토한 후, 헌법적 대응방안과 시대적 변화에 맞는 정책과 제도를 모색해 보고자 한다.

영문 초록

This paper examines structural factors affecting family changes in Korea and makes implication for family policy. The Korean has greatly experienced the family changes such as the decrease of childbirth ratio and family size, and the increase of divorce rate and the diversity of family. Recent family changes was caused by information technology, labor market flexibility, demographic imbalance. That is, family changes is a social transformation of interpersonal relationships in post-industrial society, and major characteristics of such changes is familial diversity. But this changes could not be understood by simply enlargement of the rights to choose. We cannot deny that all kinds of family are isolated from community, being reduced in scale and dissolved in the long term individualizing trend owing to the materialization of human relationship in the capitalist societies. Furthermore, divorce and remarriage rates have dramatically grown up and the recent influx of foreign labor has increased ethenic diversity. These trends have surely led to the diversification of family, the emergence of new family styles such as a single parent family and a step-family. It is understandable to take the phenomenon for granted and to argue for supporting the new family styles to function properly. However, this view seems to be so much obsessed with criticising the conservative pro-family ideology which regards only the ‘standard-family’ as normal. The author of this paper tries to show that the family diversity argument can rationalize or even mystify the dissolution of diverse traditional families by representing it as ‘family diversity’. As a matter of fact, the appearance of family diversity can be a superficial outward show of converging diverse families into ‘temporal monogamy’.
