국문 초록

본 연구논문은 DAP의 조건변동에 따른 위험의 변경과 책임에 관한 문제를 분석하였다. DAP 거래조건에서 보험체결 후에 목적지(최종 도착장소)까지의 전 구간의 위험의 변경으로 발생하는 사고에 대해서 보험면책이라는 원칙을 적용하면 보험계약체결의 취지에 반하게 된다. 따라서 DAP 거래조건 위험변경의 효과적용에 대해서 재검토 되어야 한다. 만약 DAP 거래조건 관련 소송이 제기된 경우 현재의 국제관행으로는 자국의 국내법과 상충이 되지 않는다면 면책책임 적용범위 등을 반영하여 판결을 내리고 있다. 이는 기존관행의 구체적인 의미 해석 및 DAP 거래조건의 실무적용을 결정하게 되는 것을 의미한다. DAP 거래조건으로 보험 계약시에는 이러한 내용들을 엄숙히 숙지하여 차질이 없도록 하여야 한다. DAP 거래조건의 위험의 변경 측정시점은 계약체결시점을 기준으로 하여 이뤄진 것을 바탕으로 산출된 보험료는 보험기간 동안에 계속 동일하게 된다는 전제조건이 부과되며, 만약 보험계약 기간 동안에 위험이 변동되게 된다면 매도인/매수인이 설정한 위험의 상태에 변화가 발생한다고 볼 수 있다. 따라서 본 논문은 DAP 거래조건의 실무적 적용범위 및 서류적용의 고려사항 등에 대하여 검토하고자 하였다.

영문 초록

Purpose : This study speculated on Change of Risk and responsibility according to the change of DAP conditions. Design, Data and Methodology of the Study : If a principle of liability is strictly applied for accidents which occur due to the change of risks in the entire process to a destination after insurance is concluded with DAP business conditions, it contradicts the intent of an insurance contract and may cause harsh results to sellers who do not have control power on sea traffic. Therefore, this study suggests that application of the DAP business conditions should be reconsidered. Results : When a suit on the DAP business conditions is made, if it does not contradict the national law, liability application is reflected. It means that the specific meaning of existing practices and application of the DAP business conditions are decided. Therefore, when an insurance is concluded with the DAP business conditions, it is important to be well aware of them. Conclusions : A precondition that an insurance bill for which Change of Risk in the DAP business conditions was measured based on the contract completion point is maintained equally during the contract period is given and a Change of Risk during the contract period, a change occurs at a risk set up by a buyer and a seller.
