왼손잡이의 기본권 보장에 관한 헌법적 쟁점

국문 초록

왼손잡이는 우리 주변에서 흔히 발견할 수 있다. 하지만 대한민국은 오른손잡이 중심의 사회이다. 물론 오른손잡이 중심의 사회가 문제될 이유는 없다. 그러나 왼손잡이를 간과한 사회는 문제될 수 있다. 가령 다수의 오른손잡이 중심의 사회로 인하여 소수자인 왼손잡이의 권리가 제한될 경우, 이러한 사회는 자유민주주의의 다양성 존중 원칙에 부합하지 않을 수 있는 것이다. 왜냐하면 다양성 존중의 결핍으로 인한 왼손잡이의 기본권 제한은 우리 헌법의 자유민주주의가 지향하는 소수자보호라는 헌법의 정신에 반하는 것이기 때문이다. 그러므로 국가제도 아래에서 왼손잡이는 어떠한 불편과 제한이 있는지 소수자보호의 맥락에서 “다양성 존중”의 시각을 견지하여 살펴보고자 한다. 살펴보면 오른손잡이 중심의 교육환경으로 인하여 왼손잡이의 능력을 신장함에 있어 불편 내지 한계가 있을 수 있다. 자유민주주의 사회에서 모든 국민은 각자의 개성과 그러한 개성을 통해 능력을 최고도로 신장시킬 수 있는 교육환경에서 교육을 받을 권리를 보장 받을 수 있어야 한다. 마찬가지로 손잡이에 따른 교육환경 및 교육편의시설을 자유롭게 선택할 수 있는 권리를 보장하기 위해서는 왼손잡이의 개성을 존중하고 더 나아가 왼손잡이의 능력을 신장하기에 적합한 교육환경 및 교육편의시설에서 헌법 제31조 제1항의 ‘균등하게’ 교육을 받을 권리를 보장받을 수 있어야 할 것인바, 이는 소수자보호의 원리와 다양성 존중의 차원에서 모색할 수도 있다고 판단된다. 그리고 현행법령에서 경례ㆍ선서방식을 오른손으로 제한해온 것은 질서유지를 위한 유산으로 볼 수 있겠으나, 우리 사회윤리의 본질적 구성부분을 이루고 있는 가치질서의 측면에 대한 부조화로 볼 수도 있다. 즉, 군인경례(제식)가 갖는 특수성과 달리 일반적인 국민의 경례ㆍ선서까지 왼손을 제한하는 것은 왼손잡이의 일반적인 행동자유권 또는 개성의 자유로운 발현권 제한의 가능성이 있고, 이러한 제한이 그 정당성과 이를 달성하기 위한 수단의 적정성에 비추어 합리적 근거가 없는 것이라면, 특별한 사정 또는 왼손잡이 및 장애등을 고려하여 헌법 제10조의 행복추구권과 자유민주주의가 지향하는 소수자보호의 원리에 부합할 수 있는 방향으로 개선하는 것이 다양성 존중의 차원에서 요구되는 헌법적 쟁점이라 할 것이다.

영문 초록

Left-handed is often found around us. But Korea is a right-handed society. It does not matter for right-handed society. However, it has problem of ignoring for left-handed. For example, if the right of left handed is limited caused by right handed, it is not fit for diversity of democracy society. In other words, limitation of fundamental rights for left handed caused by the lack of respecting diversity, it is against the spirit of constitution regarding protection of the minority under the liberal democracy of Constitution. First, there is limitation to improve the ability of left handed caused by the education system of right handed. All of the people have the guarantee of right for education to improve the ability by personality. Like wisely, we have to respect the personality of left handed in order to guarantee of right to choice of education system and amenities, furthermore, right to be educated equally in Article 31 of Constitution for left handed, it can be possible for us to find a difference of protection of the minority and respecting diversity. In addition, salute and oath is the legacy of right handed to maintenance of order. on the other hand, it deems disharmony in value order of social ethics in contrast of military salute, it is possible for left handed’s salute and oath to limitation of general right to freedom of action or freedom to act according to one’s natural personality. If this limitation has no legal basis compared with justification and propriety, it has constitutional issues in respecting diversity. So it is essential to improve the right for the protection of the minority aimed at Article 10 of Life, liberty and the pursuit of happiness & liberal democracy in the light of special consideration or left handed or disable.
