국문 초록

도서정가제 정착을 위한 법제화가 국회에서 추진되고 있다. 2013년 1월 도서정가제를 규정한 출판문화산업진흥법 제22조를 일부 개정하는 '출판문화산업진흥법 일부 개정 법률안'이 국회에 발의되었다. 그 내용을 보면, 완전한 도서정가제가 아니라 10% 할인을 허용하는 현행 법률을 그대로 따르고 있고, 사회복지시설에 판매하는 경우 도서정가제 예외를 인정하는 점 등 미흡한 면이 있지만, 다음 세 가지 면에서 현행 법조문에 비하여 진일보한 내용을 담고 있다. 첫째, 도서정가제의 법률적 근거를 '공정거래에 관한 법률'이 아니라 출판문화산업진흥법에 두고 있는 점이다. 둘째, '발행일로부터 18개월이 지난 간행물'을 삭제한 점이다. 셋째, 도서관에 판매하는 간행물에 도서정가제의 예외 인정을 없앤 점이다. 도서정가제 법제화와 함께 이루어져야 할 서점ㆍ출판계 및 정책 당국의 과제는 다음과 같다. 첫째, 완전한 도서정가제로 나아가야 한다. 둘째, 중소서점 살리기에 모든 정책적 지원을 아끼지 말아야 한다. 셋째, 지역문화 발전에 견인차 역할을 할 수 있도록 지역 서점들을 육성ㆍ지원해야 한다. 넷째, 독서운동을 활발히 전개해야 한다. 다섯째, 정책 당국에서는 출판산업 발전을 위한 정책적ㆍ재정적 지원을 확대해야 한다.

영문 초록

In Jan. 2013 'a partly revised bill of the Publishing Industry Promotion Act' was proposed to the national assembly. It is to amend the article 22 of the Publishing Industry Promotion Act, which states the conditions for the fixed book price system. The amendment bill is not satisfactory in that it is following the present fixed book price law in some aspects, i.e. allowing the 10% discount of the book price and giving an exception to the fixed book price when selling books to the social welfare institutions. However, the amendment bill has progressed in several ways. The most important points are as follows. First, the legal basis of the fixed book price system is on the Publishing Industry Promotion Act, not on the Fair Trade Act. Secondly, the amendment bill has removed the clause which gives an exception to the publications past 18 months after the date of publication. Thirdly, it has also removed the clause which gives an exception to the publications sold to the libraries. With the improvement of the present law of the fixed book price, there are several tasks to be carried out at the bookstores, in the publishing field, and in the government authorities. First, efforts should be made to achieve the 100% fixed book price system. Secondly, there should be all the support for the survival of the small and medium-sized bookstores. Thirdly, there should be the support of policies for the regional bookstores so that they can be leaders of the culture of their regions. Fourthly, reading promotion campaigns should be run actively all over the society. Finally, the government authorities concerned should make supporting polices for the development of the publishing field.
