J.오스틴1790 출생 의 분석적 법리학analytical jurisprudence과 H.J. 메인1822출생의 사회학적 법리학sociological jurisprudence의 영향을 받은 법철학임. 하지만 지금의 한국에서는 법리학이라는 말을 쓰지 않고 법철학이라는 용어를 통일적으로 사용함. 결론적으로 말하면 이런 법의학적인 법철학은 영국미국및 프랑스 독일등의 언어의 로마제국의 라틴어등에서 유럽언어가 일본과 한국에서의 언어로 변환되면서 많은 철학적인 사고에서 언어적인 장벽을 넘지못해서 법이나 의학을 다루는 전문가들이 잘못 사용하는 일을 발생함.

INTRODUCTION.
MEDICAL JURISPRUDENCE[ 1] may be defined, a science by which medicine, and its
collateral branches, are made subservient to the construction, elucidation, and
administration of the laws; and to the preservation of the public health.
It accordingly resolves itself into two great divisions―into Forensic Medicine,
comprehending the evidence and opinions necessary to be delivered in courts
of justice; and into Medical Police, embracing ii_b the consideration of the policy
and efficiency of legal enactments for the purpose of preserving the general
health, and physical welfare of the community.
