학교폭력 대응기구의 법·제도적 개선방안

국문 초록

학교폭력이 심각한 사회문제로 대두되면서 국가적 차원에서 학교폭력의 예방과 대응과 관련하여 특별법을 제정하는 한편, 다양한 대응체제를 구축하여 대처하고자 하고 있다. 이에 학교폭력에 대한 대응체제로서 학교폭력 전담기구, 학교폭력 심의위원회, 학교폭력 전담조사관, 학교전담경찰관(SPO) 등 다층적 구조를 갖추게 되었다, 하지만 실제 그 운용에 있어서는 이들 대응기관들의 업무수행과정에서 조사･심의･수사 기능의 중첩과 절차적 일관성 결여로 인해 실효성이 저하되는 문제점을 초래하고 있다. 이에 본 논문에서는 ｢학교폭력예방 및 대책에 관한 법률｣을 중심으로 우리나라 학교폭력 대응기구의 구조와 기능에 관한 운용실태에 대한 검토를 한 후, 주요 외국의 학교폭력 대응 기구 및 체제에 대하여 비교법적으로 분석하고, 이를 토대로 학교폭력 대응기구의 제도적 개선방안을 제시하고자 한다. 그 구체적인 개선방안으로서 먼저, 일반적 개선방안으로 사건처리절차의 단일 프레임화와 적법절차의 내실화 데이터 기반, 성과관리와 공시체계의 구축, ‘즉시분리’･‘접촉금지’의 남용 방지와 사후심사 의무화, 학교 초기대응의 전문성･독립성 강화, 조사･상담 기능의 권한 배분과 보호장치 정비, 회복적 정의의 제도적 내재화, 다기관 연계 및 정보공유 프로토콜 구축을 제시하고, 나아가 각 대응기구의 개별적 개선방안을 제시하였다. 이 논문은 특히 학교폭력 대응체계의 법적 정의와 기능 분화를 병행함으로써, 교육적 회복과 법적 정의의 조화를 이루는 방향을 제시했다는 점에서 의의를 가진다.

영문 초록

This study aims to analyze the structure and functions of Korea’s school violence response system under the Act on the Prevention of and Countermeasures against School Violence, and to propose institutional improvements through a comparative legal approach. Although Korea’s system comprises multiple layers—including school-level response committees, educational support office deliberation committees, metropolitan and provincial investigator units, and school police officers (SPOs)—the overlap of investigation, deliberation, and enforcement functions has reduced its procedural consistency and effectiveness. By comparing the systems of the United Kingdom, Japan, and Finland, this study finds that these countries define school violence in a narrower sense and operate simplified, prevention- and counseling-centered mechanisms within a unified accountability framework. Based on these findings, the study proposes four key reforms for Korea: (1) a clearer separation between criminal and disciplinary procedures, (2) legal clarification and professionalization of school violence inve- stigators, (3) specialization of the deliberation committee through expert participation, and (4) establishment of an integrated information-sharing system among education offices, schools, and police. This research contributes to the academic and policy discourse by suggesting that Korea’s school violence response should evolve toward a model balancing educational recovery with legal justice through redefinition of legal concepts and structural differentiation of institutional functions.
