독일 테러대응시스템의 특징과 시사점

국문 초록

이 연구는 최근 테러리즘의 특징을 살펴보고, 독일에서는 이러한 테러리즘에 어떻게 대응하고있는지, 그리고 그것이 우리에게 주는 시사점이 무엇인지를 알아보는 것을 목적으로 한다. 오늘날의 테러리즘은 첫째, 그 활동범위가 초국가적이고, 둘째 네트워크화된 조직을 갖추고 있으며, 세째 범죄와 상호연대하는 경향을 보이며, 마지막으로 다양한 테러수단을 사용하는 등의 특징을 가지고 있다. 이러한 테러리즘에 효율적으로 대응하기 위해서는 무엇보다도 사후적 진압방식에서 벗어나 사전예방적 대응이 필요불가피하다. 사전예방적 대응의 성공여부는 필연적으로 정보의 수집은 물론, 관련기관간 수집된 정보의 공유를 통한 적절한 대응, 즉 통합적 대응시스템의구축여부에 달려있다. 독일에서도 9.11테러를 계기로 사전예방 중심의 통합적 테러대응시스템이 필요하다는 점에 대해이견이 없다. 다만 통제받지 않는 무소불위의 권한을 가진 슈퍼경찰의 탄생을 차단하기 위한 경찰-정보기관 분리의 원칙이 헌법적 지위를 가지고 있는데, 이 원칙이 통합적 테러대응시스템의 구축에일정한 한계로 작용하고 있다는 점을 간과할 수 없다. 그럼에도 GTAZ라는 통합적 테러대응시스템을 구축하여 대테러활동의 효율성을 제고함과 동시에 정보기관에로의 권력집중을 차단하고 있다. 따라서 우리나라의 대테러활동에 있어서도 효율성 제고를 통한 테러대응 역량을 강화함과 동시에 그로 인해 자칫 어느 한 기관에 권력이 집중되는 것을 경계해야 할 것이다.

영문 초록

This study aims at improving terrorism responding system. Prior to further research, itexamines the characteristics of recent terrorism and how to respond to such terrorism in Germany. The characteristics of recent Terrorism are as follows. its scope is transnational. Another distinguishing characteristic of recent terrorism is its fluidity. This holdsparticularly true for its organisational structure, modus operandi, and the networks andindividuals behind it. Lastly terrorism is a highly complex. To effectively respond to these terrorism, above all, away from the reactive approachinevitably requires a proactive response. The success of the proactive response dependsessentially on the gathering information and analysis, as well as on the appropriateresponse by the relevant inter-agency sharing of information collected, that is based onthe building a collaborative response system. There is also no disagreement in Germany about the point that a collaborativeproactive response system is urgently required. However, the principle‘Trennungsgebot’that act as a certain limit should be taken into consideration in the counter-terrorismactivities. Nevertheless, by establishing a cooperative response system called GTAZ, itseeks to improve the efficiency of the counter-terrorism activities on the one hand, andto deter the concentration of power in the intelligence agencies on the other hand. In sum, this study shows that strengthening the power of any one institution in orderto strengthen the country's counter-terrorism activities is liable to be wary of beingconcentrated.
