국문 초록

본 연구는 근대사법의 응보적 성격이 갖는 한계를 미국의 여성철학자 수잔 브라이슨의 성폭력 경험사례를 중심으로 다룬다. 브라이슨은 자신의 수기에서 프랑스에서 경험한 성폭력과 그 재판과정을 섬세하게 묘사하며 오늘날 사법제도가 피해자에게 얼마나 무관심하고 가혹한지를 드러낸다. 본 연구에서는 그러한 원인이 근대사법의 응보적 성격에 있다고 진단하고, 그 문제점을 분석한다. 근대사법에서 범죄 개념은 피해자에게 고통을 준 ‘잘못된 행위’라기보다 국가의 ‘법을 위반한 행위’로 규정된다. 따라서 국가는 피해자의 위치를 대신하고자 하며, 범죄자의 행위가 법을 위반한 것인지를 따지는 일에 중점을 두어 유죄일 경우 그에 맞는 형벌을 가하고자 한다. 그러나 이 과정에서 피해자는 소외되며, 누구도 만족시키지 못하는 결과를 낳는다. 가해자 처벌 중심의 응보적 사법은 무엇보다 당사자들의 필요가 무시되는 문제가 크다. 본 연구에서는 이러한 응보적 사법의 문제가 국가 중심적 특성에서 기인함을 밝히고 이를 비판한다.

영문 초록

This study explores the limitations of the retributive nature of modern justice by focusing on the experience of sexual violence by the American philosopher Susan Brison. In her memoirs, Brison describes in detail the sexual assault she experienced in France and her trial, revealing how indifferent and harsh the current justice system is to victims. This study attributes it to the retributive nature of modern justice and analyses the problem. In modern justice, the concept of crime is defined as the state's ‘violation of the law’ rather than the ‘wrongdoing’ that caused the victim to suffer. The state therefore seeks to take the place of the victim, focusing on whether the offender's actions violated the law and, if so, punishing them accordingly. However, the victim is marginalised in this process, and the result is one that satisfies no one. Retributive justice focuses on punishing the perpetrator and ignores the needs of the victims. This study critiques retributive justice by identifying its state-centred nature.
