국문 초록

이 연구는 한국과 멕시코에서 나타난 민주화에 따른 국가공권력의 변화를 분석함으로써 대내외적인 안보환경이 국가의 제도적 발전과 법치의 확립에 미치는 제약적 효과를 규명한다. 법집행에 있어서의 연속성과 변화에 관한 한국과 멕시코의 비교사례 연구는 안보환경의 제약적 영향으로 인해 정치적인 민주화의 전개가 자동적으로 공정한 법집행 조직의 창출을 가져오는 것이 아님을 보여준다. 한국은 민주화 이후 자의적인 법집행 조직을 공정한 법집행 조직으로 전환시키는데 있어 부분적인 성공만을 거두었다. 분단 상황과 강력한 외부 위협의 존재라는 안보환경은 강한 경찰능력을 유지시키는데 기여하였으나 경찰책임성을 증대시키는데 있어 부정적인 영향을 미쳤으며, 이는 강한 경찰능력과 약한 경찰책임성으로 특징되던 권위주의적 경찰의 특성이 지속되는 결과를 초래하였다. 반면 멕시코의 경찰은 민주주의 전환기 동안 경찰능력과 경 찰책임성 모두 취약성을 드러내며 실패한 경찰의 양상을 보여주고 있다. 대내적 안보위협의 증대가 경찰능력을 강화시킬 필요성을 증가시켰음에도 불구하고, 법집행 목적을 위한 군대의 활용은 경찰능력과 경찰책임성을 모두 약화시키는 부정적인 결과를 초래하였다.

영문 초록

This study investigates the changing nature of state coercion in South Korea and Mexico following democratization, showing how the security environment constrains both the institutional development of the state and the entrenchment of the rule of law. Comparative case studies of South Korea and Mexico on the continuity and transformation of law enforcement illustrate that the unfolding of democratic transitions does not automatically lead to the creation of impartial law enforcement agencies due to the constraining effects of the security environment. South Korea has achieved only partial success in transforming itself from an arbitrary enforcer into an impartial enforcer; it has failed to eliminate all remnants of authoritarian policing, which is characterized by high policing capacity and low police accountability. A security environment characterized by national division and the existence of strong external threats has prevented an increase in police accountability, while also contributing to the maintenance of strong police capacity. Policing in Mexico, on the other hand, showed the failure of policing during the period of democratic transition, with low policing capacity and accountability. Even though intensified internal security threats increased the need for capable law enforcement agencies, the utilization of the military for law enforcement purposes weakened both the capacity and accountability of the police.
