국문 초록

유럽역내시장이 단일화되기 위해서는 상품·사람·서비스와 자본의 자유로운 이동이 보장되어야 하며, 이 가운데서도 남성과 여성의 평등한 대우는 사람과 서비스의 이동의 자유를 보장하기 위한 가장 핵심적인 사안 중의 하나이다. 남성과 여성의 대우의 평등의 원칙은 기본적으로 보수와 평등의 문제부터 출발하였지만 현재는 노동 및 고용조건, 사회 보장제도의 수혜와 성희롱의 문제에 까지 적용영역이 확대되었다. 현재 유럽은 인간의 존엄성과 삶의 질의 향상을 위한 포괄적인 입법 및 정책을 채택하고, 그를 시행함으로써 형식적 의미만이 아니라 실질적 의미의 남성과 여성의 대우의 평등을 보장하려는 노력을 계속하고 있다. 이에 본고에서는 EU에 있어서 대우의 평등의 원칙의 구체적인 내용 및 이를 보장하기 위한 현실적인 이행조치에 대해 고찰한다. 그리하여 남성과 여성의 대우의 평등의 보장을 통한 모든 형태의 차별의 금지의 원칙을 확립함으로써 유효하고도 경쟁력 있는 유럽노동시장을 건설하고자 의도하고 있는 유럽 사회정책의 일단을 이해하고자 한다.

영문 초록

The problem on equal treatment between men and women was nearly excluded by the EEC Treaty because it was prepared on focus of economic policies. But for accomplish the european single market. the free movement of products, person, services and capitals must be guaranteed. and the equal treatment between men and women was placed in a most important problem on the purpose of persons` free movement. The principle of equal treatment between men and women started to equal treatment of remuneration. but nowadays its application`s security and sexual harassment problem. This article try to analyze substantial contents and actual implementation measures of the principle of equal treatment between men and women in the European Union(EU). And our thesis will contribute to understanding that the european internal market cannot be accomplished without the european social policy including in particular equal treatment.
