영문 초록

In this research, market institution is decomposed into two dimensional conceptual structure. They are legal elements of property, contract, tort and human right in the altitude and functional elements of accountability, predictability, transparency and fairness in the latitude. To find the effects on market institution, the meaning of court decisions were envisioned after their projection into the devised conceptual structure . The conduct of analysis on 85 precedents, which were selected from available Korean Constitutional Court decisions 1988-2003, reaffirms the proposition that the rule of law enhance and strengthen market institutions.
