국문 초록

한국 사회는 초고령사회로의 급격한 전환 속에서 돌봄 서비스에 대한 수요가 단순히 양적으로 증가하는 데 그치지 않고, 점점 더 복합적이고 다양한 형태로 확대되고 있다. 이러한 변화에 대응하기 위해 2024년에 제정된 「돌봄통합지원법」은 지역사회 차원의 통합 돌봄체계를 구축하기 위한 법률적 기반을 마련하고자 한다. 본 연구는 이 법률의 규범적 정당성과 구조적 설계를 비판적으로 검토하고, 제도의 시행 과정에서 나타나는 제도적 및 운영상의 문제점을 분석하며, 지속가능한 발전을 위한 정책적·법률적 방향을 제시하는 데 목적을 둔다. 이 법은 대한민국 헌법 제34조와 국제인권규범(ICSECR 등)에 근거하여 돌봄에 대한 권리와 국가의 책임을 명시하고 있으며, 서비스 통합, 이용자 권리 보장, 행정 주체 간 역할 배분, 재정 지원에 관한 조항을 통해 제도적 일관성을 갖추고 있다. 그러나 부처 간 연계 부족, 지역 간 자원과 역량의 격차, 전문 인력의 부재, 불안정한 재정 기반 등의 실질적 제약은 제도의 효과적 운영을 저해할 위험 요인으로 작용하고 있다. 이러한 문제에 대응하기 위해 본 연구는 수요자 중심의 통합계획 체계 개선, 범부처 협력을 위한 거버넌스 기구의 법제화, 돌봄 인력 자격 기준의 제도화, 성과와 연계된 예산 배분 체계 도입, 지역사회 참여 기반의 강화 등을 주요 개선 전략으로 제안한다. 「돌봄통합지원법」은 돌봄을 가족 개인의 책임에서 사회 전체의 공공적 책임으로 전환하려는 초기 입법 시도로서 의의가 있으며, 그 실효성과 지속가능성을 확보하기 위해서는 강력한 제도적 실행력과 정책-현장 간의 긴밀한 연계가 반드시 필요하다.

영문 초록

Amidst South Korea’s rapid demographic transition into a super-aged society, the demand for care services is increasing not only in scale but also in complexity. In response, the Integrated Care Support Act, enacted in 2024, seeks to establish a statutory foundation for an integrated care system at the community level. This study critically examines the normative legitimacy and structural design of the Act, explores institutional and operational challenges in its implementation, and suggests policy and legal directions for sustainable development. Grounded in Article 34 of the Korean Constitution and consistent with international human rights instruments such as the ICESCR, the Act articulates the right to care and the state’s responsibility through provisions on service integration, user rights, administrative roles, and financial support. Despite its institutional coherence, practical constraints—such as inter-ministerial fragmentation, regional disparities in capacity and resources, absence of a qualified care workforce, and unstable fiscal mechanisms—pose serious risks to effective implementation. To address these issues, the study recommends enhancing needs-based planning systems, legalizing a cross-sectoral governance body, standardizing qualifications for care coordinators, introducing performance-linked budget allocation, and reinforcing participatory community-based structures. The Act represents an initial legislative attempt to transition care from a private obligation to a public right. For this transition to be meaningful, stronger institutional enforceability and closer linkage between policy and practice are imperative.
