국문 초록

오늘날 인공지능은 사회적 관심과 이슈의 초점이 된다. 어떻게 하면 인공지능기술을 발전시킬 수 있는지, 인공지능 산업을 육성할 수 있는지에 많은 논의가 이루어진다. 더불어 인공지능이 야기하는 위험에 어떻게 대응하는 게 적절한지, 어떤 규제원칙과 수단을 설계해야 하는지에 논의가 진행된다. 그러나 인공지능을 규제하는 것은 쉽지 않다. ‘지원’과 ‘규제’라는 서로 대립하는 두 축을 적절하게 조화시키면서 규제원칙과 수단을 선택해야 하기 때문이다. 이로 인해 전통적인 규제방식을 인공지능에 적용하기는 어렵다. 혁신의 시대에 걸맞게 인공지능 규제원칙과 수단도 혁신적이어야 하기 때문이다. 이러한 상황에서 영향평가는 인공지능의 위험을 적절하게 규제하는 방안으로 자주 언급된다. 여기서 다음과 같은 의문을 던질 수 있다. 왜 영향평가가 인공지능의 위험을 규율하는 방안으로 선호될까? 만약 그렇다면 영향평가는 규제이론의 견지에서 볼 때 어떤 의미가 있는 것일까? 이 글은 이러한 문제의식에서 인공지능 영향평가가 규제이론의 측면에서 볼 때 어떤 의미를 가지는지 살펴본다. 더불어 인공지능 영향평가에는 어떤 실체적 기준을 담아야 하는지 검토한다. 이 글은 영향평가가 인공지능 위험에 대한 규제원칙을 가장 충실하게 구현하는 규제방안이라고 주장한다. 이 글에 따르면 영향평가는 인공지능이 가진 복잡성을 적절하게 고려하면서 인공지능의 위험을 통제하는 규제방안이 될 수 있다. 다만 인공지능 영향평가의 실체적 기준을 어떻게 구체화해야 할 것인지는 더욱 논의해야 한다.

영문 초록

Today, artificial intelligence is the focus of social concerns and issues. There is a lot of discussion about how to develop artificial intelligence technology and how to foster the artificial intelligence industry. In addition, there are discussions on how appropriate to respond to the risks arisen by artificial intelligence and what regulatory principles and measures should be designed. However, regulating artificial intelligence is not easy. This is because it is necessary to select regulatory principles and means while appropriately harmonizing the two opposing ways of ‘support’ and ‘regulation’. This makes it difficult to apply traditional regulatory methods to AI. This is because, in responding to the era of innovation, AI regulatory principles and means must also be innovative. In this context, impact assessment is often mentioned as a way to properly regulate the risks of artificial intelligence. Here we can ask the following questions: Why is impact assessment a preferred method of regulating the risks of artificial intelligence? If so, what is the meaning of impact assessment from the point of view of regulatory theory? In this context, this article examines the implications of AI impact assessment from the point of view of regulatory theory. In addition, it examines what substantive standards should be included in the AI impact assessment. This article argues that impact assessment is one of the regulatory measures that most properly implements the regulatory principles for artificial intelligence risks. According to this article, impact assessment can be a regulatory measure to control the risks of AI while adequately taking into account the complexity of AI. However, it is necessary to further discuss how to concretize the substantive standards for AI impact assessment.
