국문 초록

저출산의 장기화와 인구의 수도권 집중으로 지역 인구의 급격한 감소와 그에 따른 지역공동체의 붕괴, 즉 ‘지방소멸’을 겪고 있다. 지방소멸은 일자리·교육·의료 등 지역사회 전반에 영향을 미치며 지역을 기반으로 유지되어 온 문화유산 보존·관리체계에도 중대한 영향을 미친다. 특히 지역의 인구는 감소하고 고령화되는 반면, 보존·관리되어야 할 문화유산의 수는 지속적으로 증가하고 있어, 현행 문화유산 보존·관리 법제가 이러한 사회환경 변화에 적절히 대응하고 있는지 검토할 필요가 있다. 문화유산은 지역의 역사적·문화적 자산이자 지역공동체의 문화적 정체성을 형성하는 기반이 된다. 문화유산의 보존·관리는 헌법상 국가의 전통문화 계승·발전 의무와도 연결되며, 국민이 문화유산에 차별없이 접근하고 이를 향유할 수 있어야 한다는 점에서 중요한 규범적 의미를 갖는다. 그러나 현행 문화유산 보존·관리 법제는 소유자 관리 원칙, 관리단체 지정제도, 문화유산돌봄사업 등을 통해 문화유산의 보존·관리체계를 형성하고 있으나, 실제 집행과 현장관리는 지방자치단체의 역량에 크게 의존하고 있다. 더욱이 문화유산 관련 제도의 발전 과정에서 지방자치단체의 역할과 책임은 지속적으로 확대되어 왔음에도, 지방자치단체의 인구 규모, 재정 여건, 행정역량, 문화유산 분포 등 지역별 차이는 충분히 고려되지 않고 있다. 본 연구는 지방소멸이라는 사회환경 변화 속에서 현행 문화유산 보존·관리 법제의 구조적 한계를 분석하고, 이를 개선하기 위한 입법과제를 제시하는 것을 목적으로 하였다. 먼저 지방소멸 시대에도 문화유산을 보호해야 할 헌법적·규범적 정당성을 검토하고, 현행 문화유산 보존·관리 법제의 주요 내용과 책임분담 구조를 분석하였다. 나아가 지방소멸에 따른 소유자 관리 기반의 약화, 지방자치단체의 재정·행정 여건 악화, 문화유산 돌봄인력 부족이라는 문제를 확인하고, 현행 법제 하에서는 지방소멸이 진행될수록 이러한 문제가 더욱 심화될 것이라는 점을 확인하였다. 이를 통해 지방자치단체의 문화유산 보존·관리 책임과 역할은 확대되지만, 그 책임을 수행할 역량은 축소되고 있으며, 현행 법제는 이를 더욱 구조적으로 고착시키고 있는 상황이라는 점을 확인하였다. 그리고 지방소멸시대의 문화유산 보존·관리 법제의 구조를 새롭게 설계하기 위한 입법과제로서 첫째, 지역 여건을 고려한 차등적 제도 설계, 둘째, 인구감소지역에 대한 특례 발굴, 셋째, 민간·공동체 기반 보존활동에 대한 법적 강화, 문화유산 돌봄인력 확보를 위한 제도 정비, 첨단과학기술 기반 문화유산 보존관리 체계의 법제화를 제시하였다. 지역의 문화유산 보존·관리에 있어서 지방자치단체의 역할이 중요하다는 점은 부정할 수 없지만, 그 부담이 지방자치단체에 과도하게 집중되는 것은 문화유산의 보존·관리의 공백을 발생시킬 수 있고 이는 우리 사회 전체가 공유해야 할 문화적·역사적 자산을 훼손하는 결과로 이어질 수 있다는 점에서 바람직하지 않다. 따라서 지방소멸 시대 문화유산이 안정적으로 보존·관리될 수 있도록 그 관리책임 분담 구조를 새롭게 재설계할 필요가 있다.

영문 초록

Korea is experiencing a rapid decline in regional populations and the weakening of local communities, often referred to as “local extinction,” due to the prolonged low birth rate and the concentration of population in the Seoul metropolitan area. Local extinction affects various aspects of local society, including employment, education, and healthcare, and also has significant implications for the system of cultural heritage preservation and management. While regional populations continue to decline and age, the number of cultural heritage resources requiring preservation and management continues to increase, raising the need to examine whether the current legal framework adequately responds to these social changes. Cultural heritage is a historical and cultural asset of a region and a foundation for the cultural identity of local communities. Its preservation and management are also connected to the constitutional duty of the State to preserve and develop traditional culture. In this respect, cultural heritage protection has important normative significance, as all citizens should be able to access and enjoy cultural heritage without discrimination. However, although the current legal framework establishes a preservation and management system through the principle of owner-based management, the designation of managing organizations, and the Cultural Heritage Care Program, its actual implementation depends heavily on the capacity of local governments. Despite the continuous expansion of local governments’ roles and responsibilities, regional differences such as population size, fiscal conditions, administrative capacity, and the distribution of cultural heritage have not been sufficiently taken into account. This study analyzes the structural limitations of the current legal framework for cultural heritage preservation and management amid local extinction and proposes legislative tasks for improvement. It examines the constitutional and normative justification for protecting cultural heritage, analyzes the current responsibility-sharing structure, and identifies the weakening of owner-based management, the deterioration of local governments’ fiscal and administrative conditions, and the shortage of cultural heritage care personnel as key problems. Based on this analysis, the study proposes legislative tasks for redesigning the legal structure of cultural heritage preservation and management in the era of local extinction.
