국문 초록

본 연구는 중대재해처벌법 시행 이후 건설업 적격수급업체 선정제도의 한계를 분석하고 개선방안을 제시하는 데 목적이 있다. 사례조사와 전문가 인터뷰 결과, 현행 제도는 안전관리 역량 반영 부족, 평가체계의 표준화 미흡, 중소업체 지원 부재, 사후관리 미흡, 최저가 낙찰제와 종합평가 방식 간 충돌 등의 문제가 확인되었다. 이를 해결하기 위해 안전관리 중심 평가체계 도입, 중소업체 역량 강화, 운영의 표준화 및 투명성 확보, 사후관리 강화, 낙찰제도와의 정합성 확보 등을 제안하였다. 특히 낙찰제도 개선은 공사 규모·위험도에 따른 이원적 운영, 안전보건 역량 가중치 확대, 사전 적격심사 강화, 인센티브·패널티 제도화, 법·제도 연계 강화 등을 포함한다. 본 연구는 제도 설계와 운영 개선을 통해 중대재해 예방과 건설업 안전보건 수준 향상에 기여할 수 있는 실증적 근거를 제공한다.

영문 초록

This study aims to analyze the limitations of the qualification system for subcontractors in the construction industry after the enforcement of the Serious Accidents Punishment Act and to propose improvement measures. Case studies and expert interviews revealed several issues: insufficient reflection of safety management capacity, lack of standardization in evaluation criteria, inadequate support for small and medium-sized subcontractors, weak post-management, and conflicts between the lowest-bid system and the comprehensive evaluation method. To address these problems, this study suggests introducing a safety-oriented evaluation framework, strengthening the capacity of small subcontractors, ensuring standardization and transparency in system operation, reinforcing post-management, and securing consistency with bidding systems. In particular, the improvement of the bidding system includes dual operation according to project size and risk, increasing the weight of safety capacity, strengthening pre-qualification, introducing incentive and penalty mechanisms, and reinforcing legal and institutional linkages. This study provides empirical evidence that can contribute to both the prevention of serious accidents and the enhancement of occupational safety and health in the construction industry.
