공인탐정제도 도입에 대한 경찰관들의 인식 연구

국문 초록

2020년 국내에서 ‘탐정’이라는 명칭으로 영업활동이 가능해지면서 관련업종의 성장이 예견되고 있다. 그러나 오랜 기간 축적되어온 부정적 이미지로 인하여 관련업계의 건전한 성장에 대한 우려의 시각도 크다. 탐정업체들의 난립과 그로 인한 과도한 경쟁을 예방하기 위하여 ‘공인탐정제도’에 대한 법안마련을 서둘러야 할 시점이다. 정부도 이러한 문제점을 인식하고 입법화를 위한 노력해 왔지만 정부 기관 간 입장차이로 성공하지는 못하였다. 이 연구는 탐정업과 밀접한 관계에 있는 경찰관들 대상으로 탐정업 도입에 대한 인식을 조사하였다. 경찰관 231명에 대한 분석결과의 핵심적인 내용은다음과 같이 요약된다. 첫째, 응답 경찰관의 84.4%가 탐정업의 법제화에 찬성하였고 15.6%는 반대하였다. 찬성이유로는‘피해자들의 권익보호나 피해구제에 도움된다’는 의견이 24.1%로 가장 많았고, 반대이유로는 ‘불법감청, 촬영 등 사생활 침해가 우려된다’는 비율이 52.8%로 가장 높았다. 둘째, 공인탐정제도의 관리와 관련하여, 관리관청으로 ‘경찰청’이 바람직하다는 의견이 67.6%로 가장 많았고, 탐정의 자격부여방법으로는 ‘시험을 통한 자격증 취득’이 바람직하다는 의견이 60.1%로 가장 많았다. 셋째 탐정업무영역에 대한 질문에서는 ‘사람의 생사나 소재탐지(실종인, 가출인, 채무자, 도피사범 찾기)’가 가장많은 경찰관들의 지지를 받았다. 넷째, 공인탐정제도의 도입으로 기대되는 효과 중에서는 ‘일자리 창출’과 ‘시민들의 피해회복에 도움’에서 5점 만점에 평균 4점 이상으로 높은 평가를 얻었다. 이러한경찰관들의 인식을 바탕으로 바람직한 법제화에 대한 제언을 더하였다.

영문 초록

As operating activities become possible in Korea under the name of 'detective' in 2020, growth in related industries is expected. However, the long-standing negative image has also raised concerns about the sound growth of the related industries. It is time to speed up the legislation on the 'Certified Detective System‘ in order to prevent rampant private detective businesses and excessive competition. In the meantime, the government has also tried to enact the detective industry, but it has not been successful due to differences in the positions of the relevant government agencies. This study is to investigate the police officers who were most closely related to the detective industry. From the key details of the overall analysis results for 231 police officers, it may be summed up as follows. First, 84.4% of the police officers in response voted in favor of legalizing the detective industry, while 15.6% of them opposed it. The reason for the approval took the most that 24.1% of the respondents said 'it would help protect the rights and interests of the victims or rescue the damage'. On the other hand, the reason for the opposition took the most that 52.8% said 'it is concerned about invasion of privacy such as illegal wiretapping, etc'. Second, regarding the management of the certified detective business, 67.6% of the respondents took the most, said 'National Police Agency is desirable as the supervisory office. For qualifications of detectives, 60.1% of the respondents took the most, said 'it is desirable to acquire certificate through examination'. Third, for questions about the area of detective service, 'detection of people's life or death, and locations(to find absconders, disappearance persons, debtors, and fugitive offenders)' received the most support from police officers. Fourth, among the expectancy effect by the introduction of the certified detective business, it earned a high rating of more than four points out of five points in 'job creation' and 'help citizens recover from damage'. Based on such police officers' cognition, this study was to add suggestions for desirable enactment.
