치안분야 드론 활용을 위한 규제 개선방안 연구

국문 초록

드론 산업의 발달에 따른 규제완화의 시대적 흐름과 조화롭게 사전 예방적 피해구제책을 마련하여야 하며, 드론 산업의 성장에 따른 안전정책을 수립하고, 향후 야기될 수 있는 보안이슈에 대한적절한 해법을 제시하여야 한다. 이를 위하여 본 연구는 드론 산업에 대한 정부정책을 기반으로 드론 관련 치안정책 이슈를 도출하고, 이에 대한 정책대안을 제시함을 그 목적으로 하며, 치안분야 드론 활용을 위한 규제개선 요인에관한 적합성 및 중요성 평가에 대하여 전문가들의 의견을 수렴하고자 델파이 기법(Delphi Technique) 을 활용하였다. 치안정책 분야 드론 규제개선 요인의 적합성, 중요성에 관한 델파이 분석 결과 영상정보 및 위치정보 수집·활용 규제 개선이 가장 중요한 것으로 도출되었으며, 드론 교통관리체계 구축, 드론 사고신고 관리 시스템 구축, 수색·구조 등 공공 서비스 참여 사업자의 비행 특례 확대, 도심 내 드론 비행을 위한 드론 운영기준 마련, 드론 비행정보 시스템 구축, 안티 드론 도입을 위한 제도 마련 등이그 뒤를 이어 중요도가 높게 나타났다. 경찰 활용적 측면에서 드론에 의한 범죄예방과 교통관제 및 법위반 증거 수집 등 법적 한계에 관한 규제 개선요인의 중요도가 매우 높은 것으로 나타났으며, 실제 활용을 위한 제도적 인프라 개선이 선제적으로 이루어져야 한다는 점을 정책 반영에 우선적으로 이루어져야 한다고 본다. 그리고 법집행기관 및 관련 보안기관의 안티 드론 작용이 활성화 될 것으로 예상되며, 이를 위한규제 개편이 요구된다. 또한 드론 범죄 및 사생활 침해와 안전사고를 예방하고 대응하기 위한 입법론적 논의가 지속적으로 이루어져야 한다.

영문 초록

Proactive damage remedies must be prepared in harmony with the trend of the era of deregulation following the development of the drone industry, and safety policies must be established according to the growth of the drone industry. In addition, appropriate solutions to security issues that may arise in the future must be presented. To this end, the purpose of this study is to derive drone-related security policy issues based on the government policy for the drone industry, and to present policy alternatives. And, the Delphi technique was used to collect opinions of experts on the evaluation of the suitability and importance of regulatory improvement factors for the use of drones in the security field. As a result of Delphi analysis on the suitability and importance of drone regulation improvement factors in the field of security policy, it was found that the improvement of the regulation of collecting and using video and location information was the most important. And expansion of flight special cases for public service providers, establishment of drone operation standards for drone flight in the city, establishment of a drone flight information system, and establishment of a system for introducing anti-drones were followed. In terms of police utilization, it was revealed that the factors for improving regulations on legal limits such as crime prevention by drones, traffic control and evidence collection of law violations are very important, and improvement of institutional infrastructure for actual utilization should be prioritized to reflect in the policy. And it is expected that the anti-drone action of law enforcement agencies and related security agencies will be activated, and regulatory reforms for that purpose are required. In addition, legislative discussions will continue to prevent and respond to drone crimes, privacy breaches and safety accidents.
