국문 초록

본 연구는 「제5차 평생교육진흥계획(2023~2027년)」의 추진과제로 학점은행제를 해외 거주 재외동포 및 외국인 대상으로 확대 제공하는 방안이 포함됨에 따라, 관련된 법적 쟁점과 과제를 분석하고, 법률적·제도적 개선 방향을 제안하는 것을 목적으로 하였다. 이에 따라 학점은행제의 현황과 법적 근거의 변천 과정을 검토하였고, 해외 과정 운영과 관련된 쟁점과 이슈들을 “학습자 모집 및 등록, 과정 운영, 그리고 기타 행정서비스 제공” 측면에서 분석하였다. 분석 결과, ‘국내 거주’ 재외동포와 외국인은 학점은행제를 이용할 수 있는 법적 근거가 이미 마련되어 있으나, ‘해외 거주 학습자’에 대한 법적 근거는 부재한 것으로 나타났다. 그리고 학점은행제의 해외 제공시, “해외 수요의 불확실성, 표준교육과정 적용, 수업 언어의 유형, 디지털 인프라 격차, 행정서비스 제공” 등의 측면에서 다양한 쟁점과 이슈가 있는 것으로 나타났다. 이러한 분석 결과를 토대로, 본 연구에서는 학점은행제의 해외 제공이 단순히 학습자 확대에 머물지 않고, 제도의 글로벌화 계기가 될 수 있도록 법률적, 제도적 개선을 위한 시사점을 폭넓게 제시하였다.

영문 초록

This study aims to analyze the legal issues and challenges associated with expanding the Academic Credit Bank System (ACBS) to overseas Koreans and foreign nationals residing abroad, as proposed in the 5th Lifelong Education Promotion Plan (2023-2027), and to suggest legal and institutional improvements. To achieve this objective, the study examines the current status of the ACBS and its legal foundations over time. It further analyzes key issues related to the implementation of overseas programs from the perspectives of “learner recruitment and enrollment, program operation, and administrative service provision.” The findings indicate that while there is already a legal basis for overseas Koreans and foreign nationals residing in Korea to utilize the ACBS, no such legal foundation exists for learners residing abroad. Additionally, various challenges arise in offering ACBS programs internationally, including “uncertainty in overseas demand, application of standardized curricula, language of instruction, disparities in digital infrastructure, and provision of administrative services.” Based on these findings, this study broadly suggests legal and institutional improvements to ensure that the international expansion of the Academic Credit Bank System (ACBS) goes beyond merely increasing the number of learners and serves as a stepping stone for the system’s globalization.
