국문 초록

본 연구는 지난 해부터 전세계를 강타한 코로나19가 장애인에게 끼친 여러 영향 중에서 장애인거주시설과 관련된 문제와 그에 따른 개선방안을 법령, 지침 및 매뉴얼을 중심으로 살핀다. 장애인거주시설은 구조 및 환경적 특성상 코로나19와 같은 감염병에 취약하며 감염의 발생시 집단감염으로 이어지는 위험성이 크다. 정부의 코로나19 감염 예방 및 대응조치 중 하나인 (예방적) 코호트 격리 조치는 방역적 측면과 시설 거주 장애인의 인권적 측면 모두에서 많은 논란을 일으켰다. 이 글에서는 장애인 거주시설 및 장애인거주시설에서의 코로나19 집단감염 현황을 살핀다. 이어서 관련 법령, 지침 및 매뉴얼의 현황을 살핀 후, 장애인거주시설에 대한 (예방적) 코호트 격리조치의 위법성을 논한다. 마지막으로는 추후 반복될 수 있는 코로나19와 같은 감염병위기 상황에 대한 장애인거주시설 관련 개선방안으로 (예방적) 코호트 격리에 관한 관련 법률상 명시적 근거 및 체계 마련과 탈시설법의 제정 및 정책 수립을 제안한다.

영문 초록

This study focuses on how COVID-19 affected persons with disabilities living in institutions and analyzes related laws, Decrees, and Manuals. This study also suggests ways to improve the situation and risks of persons with disabilities living in institutions suffers from during COVID-19. Due to the structural and environmental characteristics of institutions, persons with disabilities living in institutions are vulnerable to infectious diseases such as COVID-19 and there is a high risk of group infection. One of the Government s measures to prevent and respond to COVID-19 infection, the (preventive) cohort isolation quarantine, has caused much controversy in both quarantine and human rights aspects of persons with disabilities living in facilities. In this article, the concept and status of institutions for persons with disabilities and COVID-19 group infection in those institutions is analyzed. Then, the illegality of (preventive) cohort isolation quarantine measures for the institutions for persons with disabilities is discussed. Finally, we analyze relevant laws, decrees, and manuals and propose ways to establish (preventive) legal grounds and systems for cohort isolation and deinstitutionalization policies to prevent future repeatable infectious disease crisis situations.
